As mediators and FDRP’s working within a legal context adds complexity to our clients’ disputes. Many of our clients opt to have legal representation for the mediation, which we welcome as it assists our clients to negotiate in their best interests. However, having solicitors present does change the dynamic. As mediators, being able to adapt and manage this dynamic is essential.
